Eligibility
Intended eligibility is legal residents of all countries aged at least 21 and the local age of majority at entry and award, subject to any higher local age in Schedule A.
Employees, officers and directors of Hears and agencies directly involved in administering this giveaway, and their immediate family members and household members, are not eligible. Immediate family means spouse or partner, parent, child or sibling. The giveaway is void where prohibited; this wording does not replace any required approvals or country conditions.
Promotion Period
The promotion opens at 00:00:00 on 4 November 2026 and closes at 23:59:59 on 30 November 2026, Europe/Amsterdam time, CET, UTC+1 (“Promotion Period”). Hears’ server records determine receipt times, subject to correction of demonstrable errors and applicable law. No entry is accepted outside this period.
Registration and Subscriber Sign-up
During the Promotion Period, visit [entry form URL] , provide your name, email, residence and age confirmation, accept these terms and complete the email subscription consent described below. Complete any stated verification before closing. Receive one registration entry, counted on that Amsterdam date. Existing subscribers may register using their existing valid consent; re-subscription is unnecessary. Unsubscribing and subscribing again does not create more registration entries.
Hears requires email marketing consent at initial entry, captured separately from acceptance of these terms by an unticked checkbox. You may later withdraw consent using the unsubscribe link without losing valid entries, further access to the daily no-purchase form or prize eligibility. SMS consent is separate and is not required.
Additional Free Daily Entries
After registration, visit [free daily entry URL] using the same email to request enough no-purchase entries to reach five for that Amsterdam calendar day. One request can claim the remaining allowance. No purchase, payment details, sharing or explanation is required. Initial subscription is addressed in section 4; no renewed consent is required for daily entries. Return on later days to claim their allowance. Requests must arrive that day; no backdating. We will confirm credited entries.
Bonus Entries Linked to Purchases
Registered eligible entrants receive one bonus entry per complete US$10 of Qualifying Spend on hears.com in an Amsterdam calendar day during the Promotion Period, subject to that day’s five-entry limit. Use your registered email at checkout. Orders placed before registration may count if you register before closing and they can be reliably matched; they retain their original payment date for the daily cap. Creating a cart does not qualify.
Qualifying Spend is the amount actually paid for eligible products after discounts, excluding delivery charges, VAT or sales tax, duties, gift card purchases and other fees. Products paid for with a gift card may qualify; buying the gift card itself does not. Only direct consumer orders placed and successfully paid on hears.com during the Promotion Period qualify. Marketplace, reseller and wholesale orders do not qualify. Product prices are not increased because they carry giveaway entries.
Orders in currencies other than USD use daily conversion rates.
Equal Treatment and Entry Limit
Maximum five entries per person per calendar day, 00:00:00 to 23:59:59 Europe/Amsterdam time, CET, UTC+1, across registration, purchases and free requests combined. The 27-day Promotion Period therefore permits at most 135 entries per person. This is a person limit, not a separate limit per email, account, household, order or entry method. Different genuine entrants at the same address may each participate.
We credit valid entries in receipt order until the relevant daily limit is reached. Additional entries for that day are not carried forward. A purchase does not add entries once the daily cap has been reached. Free entrants may obtain the same daily maximum. Every valid entry is included in one common draw and has the same chance of selection regardless of source. Multiple identities may not be used to evade the cap.
Cancellations Refunds and Corrections
Before the draw, cancelled, refunded, unpaid or charged back amounts are removed from Qualifying Spend for the original payment day. Partial refunds trigger the same daily recalculation. Free and registration entries remain valid. If a free request for that day exceeded the allowance only because purchase entries then occupied it, retain its original timestamp and credit the now-available free entries up to five. No new request may be backdated. Hears will keep a record of all corrections.
Any adjustment must use the same published calculation for everyone. We will not postpone or refuse a lawful refund because of the giveaway. After the draw, an ordinary lawful return does not automatically forfeit an awarded prize; proven entry fraud is handled separately under section 12. To query an entry balance or a matching error, contact [email] promptly and, if practicable, before the draw. Statutory rights are unaffected.
Prize Description and Value
There is one winner who chooses one of three alternatives: (a) a two-night getaway for two in Ibiza; (b) a two-night relaxing getaway for two at a five-star hotel and spa selected by Hears; or (c) US5,000 in total. Spa treatments are included in option (b) within that budget. Unused travel budget is issued as a voucher for the trip hotel, as described below. These are alternative choices, not three prizes.
The two travellers share a standard hotel room. Flights are economy including 1 carry-on and 1 checked bag. Hears selects the spa hotel; for both travellers. Ibiza inclusions beyond flights and hotel are non-applicable. Travel dates will be discussed and agreed with the winner before booking, within the published restrictions. Hears will offer an option within budget; optional upgrades require the winner’s advance agreement to pay any extra cost.
Travel dates are agreed with the winner; book by January 1st, 2027. The cash alternative is paid by bank transfer within 30 business days of verification and selection, subject to lawful withholding. Maximum total prize value, including any hotel voucher, is US$5,000.
Travel Arrangements
The winner and companion must meet the published travel conditions and hold valid identification, passports, visas and other required documents. Companion minimum age: 21 years old. Both must travel together on the same itinerary and share the stated hotel accommodation unless expressly agreed otherwise. No particular airline, hotel brand, club admission or event is included unless expressly listed in section 9.
Costs not included in section 9 are passports, visas, travel insurance, travel to the departure airport, incidentals and personal spending. Any compulsory booking charges or travel taxes payable by Hears must be included in the stated prize value. The winner will not be required to buy Hears products or pay a fee to claim the prize.
Before booking, Hears will provide the applicable supplier terms and agree the itinerary with the winner within the published prize restrictions. Supplier terms do not remove Hears’ obligations under these giveaway terms or mandatory consumer law. Additional optional services requested by the winner are at the winner’s expense only if agreed in advance.
Hears will provide legally required prize and tax documentation. The winner may decline the prize before accepting it.
The prize is not transferable except where required by law or expressly agreed by Hears. If an advertised component becomes unavailable for reasons outside Hears’ reasonable control, Hears may provide an equivalent or greater value alternative, subject to mandatory law, required regulatory approval and any applicable winner consent. The winner is not responsible for replacing a component that Hears or its supplier fails to provide.
Draw and Prize Claim
One potential winner will be selected from all valid entries in a random draw on 1 December 2026 at 12:30 Europe/Amsterdam, CET, UTC+1, at Koningsplein 1, 1017 BB Amsterdam, Netherlands, conducted by Hears BV. S. Odds depend on the total valid entries received and the number credited to the individual entrant. The daily cap does not mean one chance per person: each credited entry participates.
We will contact the potential winner from support@hears.com using the registered email address within 3 business days of the draw. The potential winner must respond within 10 calendar days after notification, subject to any longer mandatory local period, and provide reasonable evidence of identity, age and residence through a secure process. Only documentation necessary to verify eligibility and deliver the prize will be requested.
A potential winner becomes the confirmed winner after eligibility checks and any lawful local conditions in Schedule A are completed. Any acknowledgement or travel documentation must be reasonable and must not waive non-excludable rights. We will not ask for account passwords or payment to release the prize.
If a potential winner is ineligible, declines the prize or does not respond within the stated claim period despite reasonable contact attempts, an alternate will be selected randomly from the remaining valid entries, subject to local requirements. We will continue the applicable lawful process to award the prize rather than retain it because of low participation.
Fair Participation
Entries must be submitted by eligible real individuals for themselves. We may reject entries or disqualify a participant on reasonable documented evidence of fraud, impersonation, automated bulk entry, deliberate interference with the website or attempts to evade the per-person limit. We will not reject valid entries merely because the free route was used. Administrative decisions remain subject to complaints, mandatory law and any applicable regulator oversight.
Entrants are responsible for providing accurate contact details. Hears will take reasonable care to operate the entry system and correct demonstrable administrative errors fairly. We will not broadly disclaim responsibility for our own failures or invalidate entries arbitrarily.
Disruption or Required Changes
If fraud, a serious technical failure or an event beyond reasonable control materially prevents fair administration, Hears may take proportionate steps necessary to protect participants, subject to applicable law and any required regulator approval. We will announce permitted changes promptly on [this URL], preserve valid entries where practicable and avoid disadvantaging entrants. We will not reserve a general right to reduce the prize, change eligibility retrospectively or cancel merely because participation is lower than expected.
Personal Information and Marketing
The controller is the promoter identified in section 1. We process entry details, qualifying order references, entry counts and necessary verification information to administer this giveaway, prevent fraud, contact the winner, deliver the prize and meet legal obligations. The giveaway privacy notice at [URL] and our privacy policy at https://hears.com/policies/privacy-policy explain applicable lawful bases, recipients, international transfer safeguards, retention periods, individual rights and how to contact us or a supervisory authority.
The giveaway privacy notice must specify the operational retention period [insert period or objective criteria], and any longer legally required retention. Necessary information may be shared with contracted administrators, secure technology providers, travel suppliers and authorities where legally required, subject to appropriate safeguards. Information will not be sold as a condition of entry.
Email marketing consent is required at initial entry under section 4, subject to its legal review hold. You may unsubscribe at any time without losing valid entries, further access to the no-purchase daily form or prize eligibility. Promotional photographs, testimonials and use of the winner’s image require separate voluntary consent unless a specific lawful local rule applies. Refusing optional publicity does not forfeit the prize.
Liability Complaints and Governing Law
Nothing in these terms excludes or limits liability for fraud, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded or limited. Mandatory consumer, privacy and other statutory rights remain unaffected. Any allocation of responsibility for travel services is subject to applicable mandatory law.
Please send complaints to support@hears.com. We will acknowledge a complaint within 5 business days and aim to resolve it within [number] days, subject to mandatory local requirements. Entrants may also contact their competent regulator or use available legal remedies.
Subject to mandatory laws applicable in each entrant’s place of residence and Schedule A, these terms are governed by the laws of the Netherlands. This choice does not deprive consumers of mandatory protections or the right to bring proceedings in a court available to them under applicable law. No mandatory arbitration, class action waiver or exclusive foreign forum is imposed by these terms.
Platforms and Third Parties
Where advertised on Instagram or Facebook, this giveaway is not sponsored, endorsed, administered by or associated with Instagram, Facebook or Meta. Those platforms are released from claims relating to this giveaway only to the extent permitted by applicable law. No hotel, airline or venue is a sponsor unless expressly identified as such in the final prize description.
